Fan Memories, Fan Spaces, Eternal Seat, Eternal Ticket, Living Memory, and Fan in life, Fan afterlife – Terms and Conditions

The proprietary program of Fan Memories™ is executed by Eternal Fan™. This custom program allows Fans to continue the relationship with the Venue. Eternal Fan is the partner of the Venue which conducts the sales and services for members of the program. Eternal Fan has extensive industry experience catering to families who desire something more than just a standard Celebration of Life. Eternal Fan is built as a sports marketing company with an emphasis on experiential Fan opportunities related to services of life. Eternal Fan was created to provide the Fans a better way to enjoy the places where great memories have been made.

The Fan Memories program offers private Fan Spaces™ for members to use. Enrollment in the Eternal Fan™ Club by purchasing an Eternal Seat™ will give the member the right to select and use a private space in a structure at a venue. The member can use the space to self-store personal items, such as a person’s own Living Memory™, with the following restrictions: 1. Items cannot be explosive, corrosive, illegal, bio-degradable, perishable, hazardous or otherwise a danger to either humans, animals, the structure, the venue, or the environment around the structure or venture; 2. All items must be in a sealed and/or secured in a suitable container; and 3. All items (including cremated remains) must fit into a space with dimensions of less than 12x12x12 inches. The term Living Memory is the conversion by Eternal Fan of a person’s cherished items which may include personal items, such as clothing, hats, pictures, tickets, cremated remains, keepsakes, and lets them have those items be integrated in a Fan Space. The term Fan Space is the sports equivalent term related to the final disposition space, but with the availability to not have the terms and conditions related to such space. The Fan is entitled to place, store, and enjoy all of the benefits of membership in the Fan Memories program without an annual fee. 4. The items are self-stored by Eternal Fan thru The Eternal Fan Way™. An Eternal Seat is presented to an Eternal Fan as proof of enrollment in the Fan Memories Program. The acceptance of the terms and conditions permits the Fans to visit their Fan Space. The Fan may have the opportunity to have additional services thru membership including: Victory Lap Experiences, Pace Car Rides, Celebration of a Fan’s Life, and special tributes related to their Living Memory. This enrollment confirms that a Fan is officially, a “Fan in life, Fan afterlife.”™

The Fan Memories™ program also offers shared Fan Spaces for members to use. Enrollment in the Eternal Fan™ Club by purchasing an Eternal Ticket™ will give the member the right to self-store personal items in a shared space in a structure at a venue. The member can use the shared space to store personal items, with the following restrictions: 1. Items cannot be explosive, corrosive, illegal, bio-degradable, perishable, hazardous or otherwise a danger to either humans, animals, the structure, the venue, or the environment around the structure or venue; 2. All items (including cremated remains) must be in a sealed container inside a cloth bag provided by Eternal Fan; and 3. All items must fit into the cloth bag provided by Eternal Fan, but in all cases a space with dimensions of less than 12x12x12 inches. 4. The items are self-stored by Eternal Fan thru The Eternal Fan Way™. An Eternal Ticket is presented to from Eternal Fan as proof of enrollment in the Fan Memories Program. The acceptance of the terms and conditions permits the Fans to visit the area of shared Fan Spaces. The Fan may have the opportunity to have additional services thru membership including: Victory Lap Experiences, Pace Car Rides, Celebration of a Fan’s Life, and special tributes related to their Living Memory. This enrollment confirms that a Fan is officially, a “Fan in life, Fan afterlife.”™

Access the private Fan Space or the shared Fan Space is limited to a single time after payment of the enrollment fee. Additional access is permitted to private Fan Spaces upon payment of additional fees. Additional access to shared Fan Spaces may be permitted at the discretion of Eternal Fan, upon payment of additional fees.

Timing for access is at the discretion of Eternal Fan and will normally be set around the main or important events at the venue. There may be additional Fan’s services related to their Living Memory such as experiential celebrations of a Fan’s life. These services are at the discretion of the Venue and will need to be coordinated via Eternal Fan and Venue.

In addition to the private Fan Space or Shared Fan Space, the member has the option to add one name to the Fan Roster, where the Fan Roster will be placed in the area of the structure and at the discretion of Eternal Fan. The Fan Roster serves as the physical naming rights for the Fans whom have enrolled in the Eternal Fan Club. This roster will be a permanent naming area for all to see each time they visit the Venue.

The personal items inside of the private and shared Fan Spaces are the property of the members, while the structure per se remains the property of Eternal Fan or other owner. Eternal Fan and venue will assume no risk nor any liability for the items while located in the private or shared Fan Space, no matter the cause. After an item is placed in a structure, a member is not entitled to any refund of any enrollment fee.

Members may visit the structure at the discretion of Eternal Fan and the venue, but generally during normal business hours. Members agree to be bound by all rules and requirements of the venue, including the requirement that a separate ticket to enter the venue be purchased before visiting the structure. The placement of structures will be at the discretion of Eternal Fan and the venue. The structure may be relocated at the discretion of the venue. Members will not be notified if the structure is re-located on the property of the venue. If the venue permanently closes or the structure is to be relocated off the property of the venue, then members will be notified in accordance with state laws where the structure is located and members will have the opportunity to retrieve their personal items. If personal items are not retrieved within 90 days of notification by Eternal Fan or the venue, then members agree that their personal items may be treated as abandoned property and disposed in accordance with state law.
